US Court Orders Freedom of Abrego Garcia from Immigration Custody

A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her order.

The situation originates in a erroneous deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her decision, the judge noted that the government lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The court challenge center on conflicting claims. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.
